New DOT Drug Testing Rules
[December 19, 2024: More than 19 months later and we are still waiting for the promised approval of labs for oral fluid testing. Shame on you US Government. When the list is released, you’ll find the labs here. Thankfully, the May 2023 rule has had a few positive technical corrections and is finalized (click here to read the rule in its entirety). However, the IPA is aware of a new proposed rule that would modify the observed collection process for US Department of Transportation drug testing – effectively eliminating the oral fluid option for an observed test only for an extended period. The IPA has submitted a response that you can see here and a press release about it here. You can submit your own comment to the DOT at this link. We continue to work with our industry contacts to stay on top of this situation. Stay tuned for more. We hope soon!]
Our original update on new rules
from May 2, 2023:
Click here for the IPA Press Release (May 11, 2023): feel free to share with your local media outlets.
The proposed rules for the US Department of Transportation (DOT) were open for public comment for the addition of Oral Fluid Specimen Testing for Drugs in March and April 2022. The International Paruresis Association thanks those who supported our effort to ensure the most favorable rules were adopted for people suffering from shy bladder syndrome by submitting their comments to the US Government.
While the federal Substance Abuse and Mental Health Services Administration had adopted rules for oral fluid collection for workplace drug and alcohol testing programs, individual agencies could – and can still – decide whether to provide an oral fluid option using those rules. The DOT is a bellwether for other government agencies. Many other departments follow the DOT’s lead in implementing their own rules. So, it is important they get the DOT process correct.
The comment period was the paruresis community’s ideal opportunity to ensure fair treatment of those suffering from this social anxiety. Our goal is for employees to have the right to choose oral fluid testing upfront or to improve options and processes for those who may still be required to undergo urine testing.
We’re convinced that the personal stories that were shared made a significant impact. Thank you for taking full advantage of this chance to share concerns about the unfair rules to make new rules available to all, starting with the Department of Transportation. If you need more information, use the Contact the IPA form and we’ll respond as soon as possible.
Again, thanks for your time and your effort.
